{"id":10879,"date":"2023-07-07T14:43:14","date_gmt":"2023-07-07T12:43:14","guid":{"rendered":"https:\/\/dev2.marketsonline.co.za\/spoor_bkp\/?p=10879"},"modified":"2023-07-12T12:05:58","modified_gmt":"2023-07-12T10:05:58","slug":"the-rise-of-inventive-machines-and-patents-in-the-united-states","status":"publish","type":"post","link":"https:\/\/dev2.marketsonline.co.za\/spoor_bkp\/zh\/the-rise-of-inventive-machines-and-patents-in-the-united-states\/","title":{"rendered":"The Rise of Inventive Machines &#038; Patents in the United States"},"content":{"rendered":"<p><span dir=\"ltr\" role=\"presentation\">In our previous article \u201cDABUS \u2013 The rise of the inventive machines\u201d which you can access <\/span><a href=\"https:\/\/dev2.marketsonline.co.za\/spoor_bkp\/dabus-the-rise-of-the-inventive-machines\/\"><span dir=\"ltr\" role=\"presentation\">\u8fd9\u91cc<\/span><\/a><span dir=\"ltr\" role=\"presentation\">, we discuss South<\/span><span dir=\"ltr\" role=\"presentation\"> African DABUS patent no. 2021\/03242 which has been touted as the first patent granted for an invention<\/span><span dir=\"ltr\" role=\"presentation\">\u00a0created by an <\/span><span dir=\"ltr\" role=\"presentation\">artificial intelligence (<\/span><span dir=\"ltr\" role=\"presentation\">AI<\/span><span dir=\"ltr\" role=\"presentation\">)<\/span><span dir=\"ltr\" role=\"presentation\"> system, listing the AI as the inventor. This granted patent<\/span><span dir=\"ltr\" role=\"presentation\"> however stands alone, with patent offices and courts around the world rejecting corresponding patent<\/span><span dir=\"ltr\" role=\"presentation\"> applications. In our view, the DABUS patent should also have been rejected by the South African<\/span><span dir=\"ltr\" role=\"presentation\">\u00a0patent office (CIPC) in South Africa.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">In the previous article, we discuss the situation at the European Patent Office, and in Australia and the United <\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Kingdom, which can be summarised as follows:<\/span><\/p>\n<ul>\n<li><span dir=\"ltr\" role=\"presentation\">The European Board of Appeal held that the inventor cited in a patent application cannot be AI<\/span><span dir=\"ltr\" role=\"presentation\">\u00a0and must be a natural person.<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">In Australia, the High Court refused leave to appeal to a judgment of the Federal Court that an inventor<\/span><span dir=\"ltr\" role=\"presentation\">\u00a0must be a natural person.<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">In the United Kingdom, the United Kingdom Court of Appeal held that as the law stands the <\/span><span dir=\"ltr\" role=\"presentation\">inventor cited in a patent application cannot be AI.<\/span><\/li>\n<\/ul>\n<p><span dir=\"ltr\" role=\"presentation\">In the United States<\/span> <span dir=\"ltr\" role=\"presentation\">(US), the District Court and the Federal Circuit held that the term \u201cinventor\u201d is <\/span><span dir=\"ltr\" role=\"presentation\">limited to human beings in terms of the United States Patents Act. As a result, an AI cannot be named <\/span><span dir=\"ltr\" role=\"presentation\">as an inventor in a US patent application. <\/span><span dir=\"ltr\" role=\"presentation\">The Court of Appeals <\/span><span dir=\"ltr\" role=\"presentation\">also <\/span><span dir=\"ltr\" role=\"presentation\">affirmed the judgment of the <\/span><span dir=\"ltr\" role=\"presentation\">District Court. On 10 January 2023, the Court of Appeals <\/span><span dir=\"ltr\" role=\"presentation\">granted Thaler a 60-day extension to file a <\/span><span dir=\"ltr\" role=\"presentation\">petition for <\/span><span dir=\"ltr\" role=\"presentation\">certiorari<\/span><span dir=\"ltr\" role=\"presentation\"> (<\/span><span dir=\"ltr\" role=\"presentation\">\u4e00\u79cd <\/span><span dir=\"ltr\" role=\"presentation\">request to order a lower court to send up the record of the case for review) at <\/span><span dir=\"ltr\" role=\"presentation\">the Supreme Court of the United States.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">On 17 March 2023,<\/span><span dir=\"ltr\" role=\"presentation\">\u00a0<\/span><span dir=\"ltr\" role=\"presentation\">Thaler filed a petition for certiorari at the US Supreme Court. The petition was <\/span><span dir=\"ltr\" role=\"presentation\">denied by the US Supreme Court on 24 April 2023. <\/span><span dir=\"ltr\" role=\"presentation\">Thaler has reached the end of the road in the US, <\/span><span dir=\"ltr\" role=\"presentation\">\u548c <\/span><span dir=\"ltr\" role=\"presentation\">\u4e00\u4e16<\/span><span dir=\"ltr\" role=\"presentation\">t is now up to Congress to decide whether to change the law to allow for AI systems to be cited <\/span><span dir=\"ltr\" role=\"presentation\">as an inventor in a US patent application.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">As concluded in our previous article, as things stand, <\/span><span dir=\"ltr\" role=\"presentation\">the current patent laws do not make provision <\/span><span dir=\"ltr\" role=\"presentation\">for AI being recognised as an inventor, and for this to happen there will need to be a change in the <\/span><span dir=\"ltr\" role=\"presentation\">patent laws.<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>In our previous article \u201cDABUS \u2013 The rise of the inventive machines\u201d which you can access here, we discuss South African DABUS patent no. 2021\/03242 which has been touted as the first patent granted for an invention\u00a0created by an artificial intelligence (AI) system, listing the AI as the inventor.
