{"id":12809,"date":"2025-01-29T15:59:01","date_gmt":"2025-01-29T13:59:01","guid":{"rendered":"https:\/\/dev2.marketsonline.co.za\/spoor_bkp\/?p=12809"},"modified":"2025-04-07T16:58:35","modified_gmt":"2025-04-07T14:58:35","slug":"bermuda-new-trade-mark-legislation-2","status":"publish","type":"post","link":"https:\/\/dev2.marketsonline.co.za\/spoor_bkp\/zh\/bermuda-new-trade-mark-legislation-2\/","title":{"rendered":"Bermuda: New trade mark legislation"},"content":{"rendered":"<p>As we have<a href=\"https:\/\/dev2.marketsonline.co.za\/spoor_bkp\/bermuda-new-trade-mark-legislation\/\"> reported previously<\/a>, Bermuda\u2019s much-anticipated new trade mark legislation, the Trade Marks Act 2023, was due to come into effect on 1 January 2025, replacing the Trade Marks Act 1974.<\/p>\n<p>The 1 January 2025 deadline was, however, not met and the effective date was put back to 1 April 2025. Despite this, there has this has been a further delay. The new proposed date is expected to be in May 2025 although this has yet to be confirmed by Parliament.<\/p>\n<p>We also understand that the Registrar General will continue to forgo the requirement of association for those registrations that will not be completed prior to the commencement date.<\/p>\n<h4>Changes to be brought about by the new legislation include:<\/h4>\n<ul>\n<li><strong>Greater scope: <\/strong>Certification marks, collective marks and non-traditional marks such as sounds and colours can be protected.<\/li>\n<li><strong>No more association: <\/strong>The concept of association of marks is dropped.<\/li>\n<li><strong>A single register: <\/strong>The dual Part A and Part B system is replaced with a single register.<\/li>\n<li><strong>Security interests: <\/strong>There are provisions for registering security interests and expanding the provisions governing trade mark licences.<\/li>\n<\/ul>\n<p>For the time being, all trade mark matters including new applications, will continue to be governed under the old Act.<\/p>\n<ul>\n<li>New applications will be registered under the existing framework, including the initial 7-year term.<\/li>\n<li>Service marks remain subject to the provisions of the old Act.<\/li>\n<li>Priority claims are still not possible in Bermuda.<\/li>\n<\/ul>\n<p><a href=\"mailto:info@spoor.co.uk\">\u8054\u7cfb\u6211\u4eec<\/a> \u4e86\u89e3\u66f4\u591a\u4fe1\u606f\u3002<\/p>","protected":false},"excerpt":{"rendered":"<p>As we have reported previously, Bermuda\u2019s much-anticipated new trade mark legislation, the Trade Marks Act 2023, was due to come into effect on 1 January 2025, replacing the Trade Marks Act 1974.
